kyonen - Terms of Service

Welcome to Kyonen. These Terms of Service ("Terms") govern your purchase, download, installation, and play of the video game Kyonen (the "Game"), developed by Juna Sanji (vygore) ("Developer", "we", "us", or "our").
By purchasing, downloading, or playing the Game, you agree to be bound by these Terms. If you do not agree, do not install or play the Game.
1. License Grant and Ownership
- Limited License: The Game is licensed to you, not sold. Subject to your compliance with these Terms, Developer grants you a personal, non-exclusive, non-transferable, revocable, and limited license to download, install, and play one copy of the Game for your personal, non-commercial entertainment.
- No Ownership: You acknowledge that you do not acquire any ownership rights or intellectual property rights in the Game by downloading or playing it. All rights, titles, and interests in the Game remain exclusively with Juna Sanji (vygore).
2. Intellectual Property and Assets
- Proprietary Rights: All graphics, music, code, dialogue, and other elements within Kyonen are owned by the Developer or its licensors.
- Attribution: All third-party assets utilized in the Game that require attribution have been properly credited within the in-game credits screen. You may not extract, redistribute, or use these assets outside of the Game.
3. User Conduct, Fan Art, and Modding
- Permitted Uses: You are encouraged to create fan art, write walkthroughs, and stream or create "Let's Play" videos of the Game, provided such content is non-commercial and references the Game accurately. The Game OST is composed by Juna Sanji and is stream-friendly.
- Prohibited Uses: You agree not to reverse engineer, decompile, modify, or distribute modified versions of the Game’s core software without express written permission from the Developer. You may not use the Game for any commercial purposes.
4. Limitation of Liability
- "As-Is" Basis: The Game is provided to you "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind.
- Liability Cap: To the maximum extent permitted by applicable law, Juna Sanji (vygore) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, hardware damage, or system crashes arising out of your use or inability to use the Game.
5. Termination
- Breach of Terms: This license terminates automatically if you fail to comply with any part of these Terms. Upon termination, you must destroy all copies of the Game in your possession.
6. Governing Law
- Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Developer’s local jurisdiction, without regard to its conflict of law principles.
